This Privacy Policy (“Privacy Policy“) explains how Sooth Inc., a Delaware corporation (referred to as “Sooth,” “we,” “our,” “us,” and similar terms) collects information from users (each referred to as “you,” “users,” and similar terms), and how we use and share that information. We provide a variety of services through our website (https://sooth.fyi, the “Site” or the “App”) and any other software that we make available to you (collectively, the “Sooth Platform”)
By using the Sooth Platform, you agree to the terms of this Privacy Policy. Your use of the Sooth Platform is also subject to the Terms of Use posted at this link: https://sooth.fyi/terms-of-use. Capitalized terms used in this Privacy Policy are defined in the Terms of Use unless they are defined in this Privacy Policy.
- Where this Privacy Policy Applies. This Privacy Policy applies to all use of the Sooth Platform.
- Changes to this Privacy Policy. We may make changes to this Privacy Policy from time-to-time. All changes will be effective when posted on the Sooth Platform, unless we specify a later date. If we make any material changes to this Privacy Policy, we will notify you through the Sooth Platform, by email, or other communication. We encourage you to read this Privacy Policy periodically to stay up-to-date about our privacy practices. As long as you use the Sooth Platform, you are agreeing to this Privacy Policy and any updates we make to it. If you do not agree to the updated Privacy Policy, you may not continue to use the Sooth Platform, and your only option will be to terminate your account.
- Children’s Online Privacy Protection Act (“COPPA”) Compliance.
- Information We Collect. Personal Information, as defined by COPPA, is underlined.
- Email. When you register an account, you may give us your name, email address, phone number, mailing address and all other information that we request or require. If you do not wish to provide any information that we require you to provide in order to create an account, then your only option will be to not create an account and not use the Sooth Platform.
- Username. Upon account registration, users are assigned a randomly generated Username. Users do not have control over the username they are assigned.
- Usage Data. To provide the Sooth Platform to you, and to help us understand how you use the Sooth Platform and to help us improve the Sooth Platform, we automatically receive information about your use of the Sooth Platform and other Usage Data. “Usage Data” does not reveal your specific identity (like your name, address, or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, city, information about how and when you use our App, device event information, hardware settings, and other technical information. To anonymize the Usage Date, we assign users a Persistent Identifier.
- Photo. We allow users the option to upload a profile picture to personalize their account if they choose.
- User Generated Content. Our note-taking tools and other related productivity features allow users to create their own content. This is optional and is limited to text-based content.
- Year of High School Graduation. Users are given the option to provide their year of high school graduation. This is an optional data field for users and allows us to indirectly approximate the age and grade distribution of our users so that we may improve our platform and services.
- Password. In the event a user does not take advantage of the Single Sign On feature when creating their account on Sooth, we will collect and securely store the user password in order to maintain a safe and secure platform environment.
- We do not require users to disclose more information than is reasonably necessary to take full advantage of all the benefits of the Sooth Platform.
- How We Collect Information, Including Personal Information As Defined By COPPA.
- We collect information on our users directly by the user during account registration (which is required to access the Sooth Platform) and whenever the user chooses to directly provide the information such as a Photo, year of high school graduation, and any User Generated Content, all of which are optional.
- We also collect information on our users indirectly through the use of “cookies” and similar technologies to understand how you use the Sooth Platform and interact with it, to learn what content and features are popular, and to save your preferences. Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. You should consult your web browser(s) to modify your cookie settings to meet your priorities. Please note that if you delete or choose not to accept cookies from us, you may be missing out on certain features of the Sooth Platform and your use of the Sooth Platform may be negatively affected.
- How We Use Information Collected, Including Personal Information As Defined By COPPA.
- Facilitate secure account creation and management;
- Communicate with users periodically, including for administrative and promotional purposes;
- Personalize the Sooth Platform;
- Provide users with customer support;
- Provide support for the internal operations of the Sooth Platform;
- Protect our users and the Sooth Platform, by, for example, fraud monitoring and prevention;
- Enforce our terms, conditions and policies for business purposes, or to comply with legal and regulatory requirements;
- Obtain user feedback; and
- Analyze how users use the Sooth Platform.
- How We Share Your Information, Including Personal Information As Defined By COPPA.
- Legal Obligations. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
- Vital Interests. We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.
- Third Parties. We do not disclose any Personal Information to third parties. We do not allow any third parties to collect any information about our users while our users are on the Sooth Platform. We do not work with any third parties that have any access to our users’ Personal Information. All Personal Information is collected for the purposes described in Section 3.3 of this Policy. We do not collect Personal Information for any other commercial purpose.
- Information Others Collect.
- Given the nature of the Sooth Platform, our users are routinely directed to third party sites whenever users click a search result on the Sooth Platform. When users click on any of these third party links, the applicable third party’s terms and policies apply, including the third party’s privacy and data gathering practices. We do not control any third party or their collection of your information. Please review the respective party’s privacy policy to understand their collection and use of your information.
- Other websites, mobile applications and services that you interact with may collect information from you after you leave their website, including information related to your use of the Sooth Platform. We do not control any third party or their collection of your information. Please review the respective party’s privacy policy to understand their collection and use of your information.
- Data Retention.
- We use reasonable efforts not to retain your personal information for any longer than it is necessary for the purposes set out in this Privacy Policy. Thereafter, we will either delete your data, anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. If you wish to request that we delete or modify your information, or that we deactivate your account consistent with the foregoing, you may contact us at contact@sooth.fyi.
- Under COPPA, schools and parents have the right to review the Personal Information of their child under the age of 13 and may instruct us to delete it and/or discontinue its collection. - Data Security. We are committed to protecting the data of our users. Even though we take reasonable precautions to protect your data, no security measures can be 100% secure, and we cannot guarantee the security of your data.
